If a baby is born in Oregon to unmarried parents, do they have to file for joint custody to have the same rights? If so, how would they go about it?
1st- It's not me I'm asking about 2nd- The parents are together and he is on the birth certificate and 3rd- rude comments are unnecesary. They want to know out of curiousity. It's not about pursuing support or anything.

A father can file an action in the local family court, seeking a determination of paternity and joint custody.

Mother is educated, studying for PhD, has steady income of $1200 pcm. Father doesn’t have high school diploma, works in retail or catering making $2000 pcm but changes job a lot because he gets sacked. Battle over custody. Mother got her green card through US Citizen husband who is the father of the child.

Who gets child custody?

The child stays with the mother, most courts always grant custody to the mother unless she gives it to the father, because then the child will be able to stay in the US, if they have been together long enough to meet the letter of the law, then she can stay here too. Talk to a good immigration lawyer.

There is a situation involving a 4 year old child that recently started kindergarten. The parents are separated. After trying to come to an agreement with the child’s mother, the father who has 50% custody, decided to enroll his child in the local school district near his house. The mother now wants to take the child out of school completely until he reaches 1st grade level. My question is, what option does the father have to ensure that his child is kept in school where he belongs? Can the mother remove him from the school that he is already enrolled in without the father’s approval?

Who says he “belongs” in school at the age of 4? That’s real early to be in school if he doesn’t have to be. Actually, do you mean “daycare”?

Who has primary custody? That is who gets to decide on schooling. It should be totally outlined in the custody papers.

But, you said that the parents are separated… so… when’s the divorce? That’s when the papers will be written up. If the father wants to be able to legally do this, then he needs to tell his lawyer to get it in writing in the decree.

I am going to have my kids live with me soon, and i will need to enroll them in school, I have joint legal custody of my kids, and my ex wife has primary physical custody, can i enroll my kids myself or will i need my ex wife to enroll them?

Family law has so many variations. Without paying for legal advice, I suggest you check with the school system first and be prepared with copies of the court documents, indicating who has custody, and a notarized letter from the other parent, indicating her agreement. That really ought to cover it.

This is a vid tribute to my sons taken from me by CPS. The song is Saliva Rest in pieces. I used this song because it is one of the few that describes how I feel. We have to stop CPS from ruining more families. I do not claim the song and it is the property of Saliva. Again I say I have NO rights to this song whatsoever and thank the record company for allowing me to dedicate this song to my beloved sons. Check out Saliva’s music. They ROCK!!

How I lost my sons:

On August 19, 2004, CPS cam to my home on alligations of drugging my sons and deplorable living conditions. We had just moved into a house that was freshly remodeled. I hadn’t unpacked everything before CPS forced me to move again. They charged me with failure to protect because I had a small bruise on my breast the size of a fingernail. This is what they built their case on that my husband hit me. Our case plan was written Spetember 04 and by the end of December we had completed everything on it. A 6 month review was held on January 21, 2005, where CPS made claim that we had done nothing on the case plan and revised the old one and added 3 more things we had to do. I had no car, no job, no money and they refused to help saying that if I cared for my sons I would find a way to get money. I lost everything when they came into my life. My job, my house, my car, everything I owned, and more importantly, my sons. Jadyn was 31 months old and Joey was 15 months old. Just babies that reached for me and screamed for me when they took them from my arms. I had two more children during this time and the third one was taken into custody by another agency. But was given back to me 11 months later after I completed the case plan that the original one created. By then I had my daughter (3rd and 4th children are 10 months apart). I took my new born daughter into court with me on July 19, 2006 and had paper work and testimony from the GAL saying my sons should come home, that there was no evidence of maltreatment or deprivation as indicated by the other agency in returning my son and never taking my daughter. The judge ordered that my sons were still deprived (living in foster care) and would likely continue and terminated my rights. Less than a year later, my appeal was rejected and in September 2007, my sons were adopted by the foster family that stated form the start they wanted to adopt. The reason my sons were taken was to be adopted. Nothing more. And CPS failed to place them with a fit and willing relative as required by law. They wouldn’t even look into placement with family because family adoptions cost nothing. Even after my sons were adopted, that CPS agency tried to fight me to pay child support. But we went to court and won that one. I am hoping that by putting my story out there that someone will reach out and help this family. We have done no wrong and all we want is equal opportunities as anyone else accused of being criminals. we want a fair trial, a chance to face our accusers, a jury of our peers, everything that our Constitution guarantees us and that we were denied. Please spread the word and please sign my petition. Let’s bring reform to this country and save the families. No one should have to suffer as much as my family has. My son and two daughters deserve to know their brothers. Jadyn and Joey have a right to know their family and their heritage. To know that they are a direct descendant of General Robert E. Lee.

Custody Battle Over Baby Max Continues

Two local families remain locked in a legal battle over custody of an infant boy.

Baby Max has been staying with Scott and Tandy Kraus in Grain Valley.

“We’ve had him for almost six months. He knows us as his mom and his dad,” Tandy Kraus told KMBC. “If he doesn’t stay with us, I won’t be able to understand that.”

Previously, Max lived with his relative Gary Stocklaufer, who claimed a judge denied his custody because he was overweight.

However, a judge said Stocklaufer violated Missouri’s adoption law by bringing the newborn into the state without first getting a court order.

Scott and Tandy Kraus were ordered to turn Max over on Monday, but the couple said they disagree with the order.

I LOVE YOU THIS MUCH! – Greg Pound preaches outside the Pinellas County
Court house trying to get his children back, and to have right as an American to a trial by jury of his peers, which Judge Marion L. Fleming expressly denies him. All of this injustice against Greg and his family is based on an simple accident, that one of his children was bitten by a dog. Why would anyone take a chance on a Florida vacation, when you can lose your family to a dog bite? This court system is openly falsifying
information to get money, and denies trial by jury as supposedly guaranteed by the United State Consititution. Judge Marion L. Fleming is allowing children to be abused in horrible circumstances to keep this system going. May Greg’s children one day see what their father did to get them out of this terrible system. Greg will never give up until he gets his children back, and see justice given to those that have abused all of our children. Greg loves his children, would you go this far to save your children? Would you support Greg? Please help us to destroy this evil and wicked system, and bring these perpetrators to justice by exposing this evil to the world.
