My husband has a 2 1/2 year old from a previous relationship. He pays child support but never gets to see his son because the mother will not allow it. Every time tries to go see him, she is too busy or out of town or some excuse. Well, at the beginning of the month, she moved with his son halfway across the united states, didnt leave an address, and changed her phone number so he has absolutely know way to get ahold of her. She is still collecting child support as well. Is it even legal for her to just take him?? I thought I heard somewhere that this is considered kidnapping. Any one ever been in this situation or known someone who was?

How is he still paying her child support if he doesn't even know where she is or how to get in touch with her? Are his wages being garnished? If that's the case, there must be some type of child support order in place from the court and usually, when there is a child support order there is some type of visitation/custody agreement made as well, though they are separate issues. He needs to contact a family court lawyer right away to find out what to do here, because the mother isn't doing anything illegal by taking the child away like that if there is no custody/visitation agreement in place, so this all sounds a little odd. If he's paying child support, he does legally have rights to see his child, so he needs to contact a lawyer on this matter.

I have a child who is 3 years old and i want to take a dna test to prove that he is not mine. The mother has full custody of the child, so would i need permission from the mother to take it?

Yes, you need permission for a DNA test from the parent with custody. You can possibly go to court and if the judge feels like you have a legitimate request, she will request that the female have a paternity test done.

If the father of a child and the grandparents share joint custody of a child and the father becomes incarcerated. He gets married after the joint coustody was established. Who has legal custody of the child? The grandparents or the step mother?

Whatever is legally written down and unless the new wife adopted the children-she doesn't have a horse in this race.

The father and the grandparents will have to decide this.

and does the child have to be living with you to do it? What is procedure with filing custody of a child? PLEASE HELP!!!!

Of course you can file for custody, but you will have to hire an attorney. It sounds like this is complicated! Talk to a lawyer, most offer the first consult for free. Try to make a deal with the mother, if it is in the best interest of the child for you to have custody. You offered very limited info, but I wish you the best! And, no, the child does not have to be living with you…

how often is it that fathers get joint custody of the kids?
how is joint custody set up as?
can the mom take off with the kid without telling anybody and not get in trouble? (father signed birth certificate at birth)

Joint custody is the most popular outcome, when both parents raise the shildren, then Sole custody is for one parent to raise.
Most times joint custody is every weekend or every second weekend the father has the kids or by mutual arrangement with the mother if the father is a shift worker etc…..
Well the mother can run off with the kids, but will face serious breach of contract when found, as the contract is law, and the law will see the mother as irresponsible & reckless……..this goes for the father as well, its just not worth it, as you may have your contract temporarily suspended.

Child Support is Extortion

Men should sign an authorization form that shows he will support said child with a woman. If he defaults on that promise, THEN he should be sought after for financial support of said child.

If he doesn’t produce this form or sign it, then the woman would have no right to get financial support from men.

Because frankly, creating children is done by the woman, not the man. They only use men’s sperm. Men have no choice after sex, only women do. You can’t have responsibility without choice. A man having sex shouldn’t be a promise to support children, anymore than a woman having sex.
