Dania S. Charles Ogletree, the attorney who represents arrested Professor Henry Louis Gates, says that his client did nothing wrong, and said that because he was still taken into police custody despite giving two forms of identification for his house: “Of course, he’s angry.” “I can’t imagine many people wouldn’t be disappointed” if they were in the same situation, he says.

what rights does one have under these conditions? havent gone to court or contacted lawyer yet, couple was never married. mom is now telling dad he cant see the kid, what rights does he have in seeing his child? he hasnt had custody in over a year, only visitation which she has now revoked

This is a domestic violence case and I currently have a temporary restraining order against my husband with a hearing set for next week. The restraining order also covers custody and visitation issues. I’ve asked for sole custody with him having no visitation and he privately consents to this – can the court force visitation rights on him if he states at the hearing that he is willing to leave it to my discretion? If they do, will I be unable to leave the state?
This is in Florida.

A court is only concerned about one thing – the best interests of the child, and they can override a private agreement between the parties to achieve that. If there is a restraining order against your husband, that should weigh against him being allowed visitation. Again, depending on how the court rules and what the order states, you may be prohibited from leaving the state without permission.

Do you have an attorney representing you in these matters? If so, that person should be able to answer these questions. If not, you should get one. If you can’t afford an attorney, check with legal aid or law schools in your area. They often offer representation at a reduced rater.

Child custody forms in Tennessee?

I am about to fill out a Permanent Parenting Plan Order to modify the old parenting plan from my divorce. I downloaded the form from the internet. The old parenting plan has him as the custodial parent, which I agreed with. In the new plan, I would be the custodial parent. He says he has no problem with this new arrangement. Our child has been living with me for the past year. I was told that this fact alone is what would be considered as a "material change in circumstances". I just have a few questions.

1. Can these forms be filled out by hand and presented to the courts, or do they have to be typed?

2. Do I have to have his signature on the form to submit it to the courts?

3. If he gives me a hard time about signing the papers, can I submit them anyway?

4. Are there any other steps that I have to take in order to change the current child custody agreement?

Again, my ex said he doesn’t have a problem with signing the papers. However, he likes to make things more difficult than they have to be. I am just trying to get all of the necessary information.

The court clerk told me a lawyer was not necessary. Just fill out the forms, submit them to the courts, and pay the filing fee. Any other suggestions would be greatly appreciated. Thank you in advance to everyone who takes the time to read this and respond!
