Helping keep you informed on Parent Custody issues….

Archive for August, 2009

I am currently 30 weeks pregnant and unmarried at the time of conception. The father of my unborn baby claims he wants to be involved but he’s shown 0% effort in the pre-birth process and has made things quite difficult for me. He has recently been arrested for drinking & driving. I’m nervous for my baby’s safety and would prefer that he see her as little as possible until he gets help. What is the chance he’d be awarded any form of custody if he pursues it???

Pretty slim - he might be awarded supervised visitation, at least at first. But it’s not likely that he’d be allowed to keep the baby alone with a history of alcohol issues. Keep a record of what he’s NOT doing, because that can help you as well.

If a mother dies during labor and is not married, the supposed father wants a paternity test before he takes responsibility for the child, what happens to the child in between this process? And if he does turn out to be the father, how likely is it that the mothers family can get custody? thank you!

The father is more likely to get custody.

Both parents are 17, but the mother of the child is moving out of state with another family member and taking the child with her because the father does not want to be with her, but he wants his son. They have never been to court for custody rights. What can be done to stop her?! Just last month and this month she didn’t even want the child and gave him to the father, but recently has taken him back and is saying she is not giving him back. Help please?

He needs to immediate file an injunction with the court to prevent the move of the child pending a full court hearing.

My friend has two daughters under the age of 4. The father of the children is a complete loser and just so happens to be in prison until next September for battery of a police officer and a DUI while license suspended. She would like to move to another state and restart her life with her children. What are her chances of getting this approved by the state? She has a clean record and just wants the best for her family, although her ex is still the father of their children and is on the birth certificates. Thoughts?

If there is an order preventing her from removing the children from the state then by law she cannot do so but since the courts always favor the women even in terms of child sexual abuse nothing will happen, the Judge will just sing Biology and tell you to go on your marry way and pay to support her on everything she does

I need a form for the insurance company that says Myself and my husband have custody of our grandson. So he can be insured thru our policy. Any help?

That’s not a simple "form" to come by, a court or law would have to issue something like that, and the parents would have to give up custody.

My child has decided to move in with me, his mother, but his father has physical custody of him. Until i get physical custody of him how can i get him into a school in our district? We live in MD.

If your ex has agreed for him to move in with you, then all you need to do is get copies of shot records, birth certificate, social security card. Then just go enroll him in school and let them know which school he was attending, it shouldn’t be any big deal, your are his mother.

The Book, Instructions and Legal Forms: http://www.custodycenter.com/VOLTERM/index.html

Why am I presenting this material? To at least balance the playing field for those who need such an option. Not to mention that it is time to get family in focus even if the issue needs to be pushed forward.
