GL 05/25/09 Shayne Dinah Part 2

Dinah is now at the mini mart picking up baby stuff for Henry and Shayne. Mallet walks in and sees Dinah with all the baby stuff.

Shayne tries to talk to Marina as she pushes Henry into his stroller. Buzz asks what is happening. Marina says that she has to take her son to his doctor appointment. She says that Shayne is very emotional right now with everything. He is not thinking straight. Marina tells Shayne she is not going to let anybody ( including him ) harm her son. She wants to make sure that he is clear on that point. Marina leaves with Henry. Buzz asks Shayne what the heck happened. Shayne says it’s complicated as he leaves.

Mallet makes the umption that Dinah is pregnant. Dinah says no. She’s buying some stuff for a friend at the station. He’s a new father but he’s not sure if he’s going to be there for his child. Dinah just wants to help out by getting a couple of things for him. Mallet questions if it’s some complicated shared custody. Dinah says not yet. Mallet asks if it’s a boy or girl. Dinah says a baby boy. Mallet highly recommends the baby puppy toy. It’s one of Henry’s favorites. Dinah winces and puts the puppy back. Mallet is really puzzled about his case. He talks to Dinah off the record about the fact that he umed Edmund was a bitter vengeful man who was angry that he lost his child yet watching Edmund on that tape. Mallet knows that feels like. He would do anything to keep Henry safe and in his life. Dinah says that Henry is very lucky to have Mallet in his life. Dinah leaves.

Marina is playing with Henry at Cedars when she sees Shayne out of the corner of her eye. She picks up her son and glares at Shayne. Does she have to get a restraining order to keep him away from Henry? Shayne tells Marina to calm down. It’s not like that. Marina says that Shayne is not her friend anymore. He’s her enemy if he’s trying to get custody of Henry. They all can’t have shared custody. That would never work. Shayne doesn’t want to do that. Marina and Mallet are Henry’s parents. That is not going to change.

A Roadmap to Divorce
The Divorce Process in California
The summons and the petition for dissolution of marriage set the tone for the rest of the divorce. There are less confrontational options than to have these documents delivered to your spouse by a sheriff or process-server. − Victorville family law attorney Sharon J Brunner
Step 1. Gather Information
Once you choose a lawyer, the divorce process in California begins with gathering information such as names of the parties, birthdates and addresses, along with detailed financial information.
To obtain full and accurate information, your lawyer will need to scrutinize tax returns and pay stubs, bank statements and retirement plan accounts such as 401(k) plans. If there is an allegation that a spouse is unemployed or underemployed voluntarily, your lawyer will also review earnings history. If your spouse is self-employed, business income and expenses will need to be reviewed. For liabilities, all credit card statements, loans and other debts will need to be scrutinized and evaluated.
This step will create a preliminary balance sheet to have an understanding of the marital estate as a whole. Discovery may be necessary to force the other side to produce information and documents.
Step 2. Initiate the Divorce
To initiate a divorce, two documents will be prepared:
Summons. This is a formal notification of legal action. It provides a time for the other party to respond and a basic restraining order that prevents both parties from disposing of ets, changing insurance or disrupting the status quo.
Petition for dissolution of marriage. The petition is specific to your circumstances. It notifies the other party of issues such as marital property division, child custody, child support and spousal maintenance. This document includes a recognition that the parties have lived in California long enough to divorce in this state. The petition will state that the reason for divorce is an irretrievable breakdown in the marriage relationship. Since California is a no-fault state, that is all you have to say. The petition ends with a prayer for relief from the court.
Attorney Sharon J Brunner will seek temporary relief for child custody and visitation, child support, monthly finances, spousal maintenance and, if appropriate, attorney’s fees while your divorce is in process.
Step 3. Marital Termination Agreement (Divorce)
In California, your divorce will be concluded by a document known as a Marital Termination Agreement. You and your spouse, with the istance of your respective attorneys, will try to come to an agreement on issues such as marital property division, child custody and visitation, child support and spousal maintenance. If you and your spouse are unable to agree, a court will make a decision as to how the divorce terms are defined. That generally involves a trial.

Bulgarians Protest Child Custody Case

A decision to return two children to the custody of their Polish mother has sparked protests in Bulgaria. The childrens Bulgarian father is not happy over the decision either.
A disturbing video of last week’s removal of two children from their father’s care in the southern town of Asenovgrad was shown by Bulgarian networks.

And that motivated some 200 protestors to gather outside the Polish Embassy in Bulgaria’s capital Sofia on Sunday, May 31.

The removal took place on Wednesday when Polish citizen Barbara Vasilev tried to take eight-year-old Nikoleta and seven-year-old Pavel away from their father Todor Vasilev.

Local police, court authorities and a representative of the towns social services got involved when the children refused to leave with their mother.

A fight broke out while the authorities attempted to take the children by force.

The boy, Pavel, escaped and his whereabouts are unknown.

The girl, Nikoleta, was taken by her mother and left for Poland on Friday.

The mother claims the children were taken from their home in Poland two years ago without her consent, and she filed a claim with a Polish court to that effect.

The father denies the claim.

Bulgarian authorities issued an order to return the children to Poland on March 13, 2009.

“He committed a crime. He violated the Hague Convention and the Bulgarian State has no other option but to do what we’ve already done.”

Vasilev is appealing to the authorities for help in bringing back his daughter to Bulgaria.

“I, Todor Vasilev, right here, right now, in front of you demand that the Bulgarian state stop being passive and start supporting its children.”

Is this legal? (child custody stuff)?

So….i go to my moms for a week on sunday, then on the next sunday i go to my dads for a week. repeat. understand me? this week when i was at my dads my mom had a big fight with my step dad and he moved out and they r getting a divorce. veerrrrrry bad fight. and when they fought my step dad threatened to kill my mom and her family. so now my dad wont let us (us being me and my sister) go back to my moms because he says he has the right to keep us if my stepdad threatened us. my dad wants to have full custody over us now but me and my sister DO NOT want that at all and neither does my mom. does my dad have legal rights to keep us automatically? or can my mom fight against that?
but if we did go to court, would my dad be able to keep us for good just because we got threatened by my stepdad???/

If there was a potential for harm, than yes he can and should. Your protection takes priority over anything you may want.

My brother havent established paternity over the child yet but he’s willing and want to spend time with the baby but the mother of the child want let him. Shes a college student who stay on campus and left the baby to stay with her mother until the weekend when she get out of school. How can we handle the situation with getting the baby we want joint custody where we can have her during the week and they have her on the weekends
