I was not married to the father. His name is not on the birth certificate. We have not seen him in over 2 years. He was ordered to pay child support but hasn’t in over 2 years. He, when he use to visit her would in danger her life. He would smoke around her and she has really bad asthma. He would take her for rides on his motorcycle after she had brain surgery. He drinks and he does drugs. He does have a police record. Do you know will they actively search for him or just the last place of residence that I supply to them? The reason I need this is that I’m moving out of the country to be with my husband, her step(real)father and I don’t need anything standing in the way. Otherwise if I can’t get this straightened out I will have to divorce my love and tell my daughter she will no longer have a dad. This will devastate her. Also if I do go thought the courts to get it "legal" should I tell them about me needing to move? Please I need some serious advice I really dont’ know if I can afford a lawyer right now it’s going to cost almost $10,000 to move

You already have it by default. Only Arizona has a law addressing the rights of single fathers.

california child custody laws?

I have custody of my son. But for the last year hes lived in LA with his dad. I also was sappose to live there but at the last minute he changed his mind. He has now filed temp, custody of my son. Because he has lived there the past year will the courts give him temp custody until we go back to court?

Since your son has lived in California for over a year and is (I would assume) in school here he is considered a resident. In California one only needs to live in whatever county they are in for 6 months to be considered a resident of that county. Since he is now a resident of the county he lives in it will be likely that the father will get temporary custody…and in California he can file for child support from you, including the BACK support for the past year. I suggest you talk to your lawyer.

child custody in texas?

My son is wanting to get custody of his child, the mother is unfit and she leave the baby with her aunt for months, she does drugs her boyfriend abuses her, she doesnt have a job. The child support office gave him visitation right. What can he do to get his child away from there while he is trying to get a lawyer

Little untill a judge says otherwise,
Child protective services can be called which apparently has been done before the they can intervene and get a judge to sign off on the recommendation, though if the aunt is watching the child they aren’t necessarily going to do what you want, if the child is being taken care of and is safe.

So yes you need a lawyer and sue for custody.

My friend needs to get his daughter, who is 3, away from the mother. She abuses drugs and dates questionable men. He lives in another state for now because of work. He makes good money to support his daughter, but it requires him to move to another place 3-6 months out of the year. How would he go about proving that the mother is an unfit parent? Any reasons why he might not get custody?

He needs to hire a "father’s rights" attorney, who can answer the questions AFTER getting the details of the situation.

the child is 5 and it has been going on for apparently most of those 5 years.

If a person not in jail, then clearly are not a very good parent either. So the problem here, is either you’re not been taking the necessary steps to protect your child, or you’re making this up, as happens in 60% of the cases were fathers filed for custody.
