My son is 11 and I have hime every other day and every other weekend. I do not keep him overnight during the school year. I am a great father and I feel I deserve the same things with my child that my ex wife gets.

I would go and speak to an attorney so they could advise you on what your rights are.

I am in the process of divorce. I have already file initial paperwork. My husband and I have agreed that he will not pay child support and I will have 100% custody with visitation only at my discretion. I have no idea what to put on the forms though. Do I put on there exactly what we have agreed upon?

And yes, we have both thought this through and are in AGREEMENT so please no advice about not doing this. Thanks!!!

A judge will not allow it. He will be forced to pay child support, a judge doesn’t care what you agreed, legally you cannot sign off on it anymore. That said, he can sign off his rights to visitation and or custody. He will still owe child support they will garnish his wages. It does not matter what you put on the forms child support is factored off his income by the state.

I am in the process of obtaining a lawyer but need immediate advice. My husband does not have his name on my daughters birth certificate and we were not married at the time of her birth. I would like to move to Texas as i do not feel safe living in the house with my husband.I have been advised by law enforcement my husband can not stop me from leaving Florida. My question is can i be forced to bring my daughter back to Florida taking into consideration that my husband is not on the birth certificate and we were not married at the time of birth. Please do not judge me because you do not know my situation.I am not trying to hurt my husband and would not be considering such drastic measures if our safety were not an issue. I am simply trying to make a better life for my family and want to make an informed decision.

Yes, you can leave with your daughter so long as there is not current order in place stating the child’s residence/custodial parent. HOWEVER – he is easily able to order an emergency hearing in court and a judge WILL order you back to the county until custody/visitation is determined. This is so that the state will have jurisdiction over the child.

It doesn’t matter if he’s not on the birth certificate – he’s your husband and her presumed father. If he’s going to court filing a custody order, they look at him to be the legal father.

If you just up and flee with your child and the court has to order the child’s return, it’s really not going to look good on you. Speak with a lawyer regarding a restraining order/order of protection for the child if you feel that she’s in danger. Best of luck.

If the father of a child is no longer alive, but he left behind his estates and wealth for the child. The mother of the child was ex-wife of the father. can she get custody of her by law and lives to take advantage of her.

Not unless she lost her rights to her child. If not, as the mother she is the only one who has rights to their daughter. Now, if the father left his estate and money for the child he would have needed to assign someone who handles everything, if he has no parents to fight this then the mother of his child would be able to go to court to petition for this right to use the money etc. At the very least a relative can ask that the money be held in a bond till the child reaches a certain age like 18, 21, or 25 etc. and that no one can touch the money without court approval. If he has property they can ask that it be sold off and the remaining money be also put in bond for the child.

planning to leave Father of child, worried that he might try taking baby without permission, in my state father on birth certificate has same rights as i do without a court issuing custody. Any advice on how i get custody before leaving??

You can’t leave the state without getting a court order changed. They do this to keep the parents, when seperated, from moving far away and not allowing access to the child to the other parent.

Lawyer and human rights advocate William Zabel claims the International Criminal court to be a “vital international organ for justice,” but admits that the United States is unlikely to sign the ICC treaty in the near future.

New School President Bob Kerrey talks with William Zabel about his distinguished legal career, his work as chairman of Human Rights First, and his role in significant human rights cases, including the landmark Supreme Court decision which put an end to race-based bans on marriage.

William Zabel is chairman of Human Rights First (formerly the Lawyers Committee for Human Rights), a nonprofit international human rights organization. He has traveled the globe on Human Rights First’s behalf, including a 1986 trip to Chile, where he investigated cases involving those who were disappeared under the Pinochet regime. Zabel was a strong advocate for the creation of the International Criminal Court, and he helped support its growth as an effective forum for bringing human rights violators to justice. Zabel also played a key role in the landmark 1967 Supreme Court case Loving v. Virginia, in which the Court declared Virginia’s anti-miscegenation statute unconstitutional, effectively putting an end to race-based bans on marriage. Two years later, he was the lead lawyer in Weiss v. Gardner, where the Supreme Court held that a loyalty oath then required by Medicare was unconstitutional. Later, he signed the brief in Palmore v. Sidoti, in which the Supreme Court held that a white woman could not be stripped of custody of her child because she married an African American.

Bob Kerrey is president of The New School in New York City. For twelve years prior to becoming president of The New School, Bob Kerrey represented the State of Nebraska in the United States Senate. Before that he served as Nebraska’s governor for four years.
