My good friend in Oregon wants to leave her boyfriend and move to Texas . They have a child together. They are """"NOT"""" married. The baby does have the fathers last name.
Could there be any legal action taken against her for taking the baby out of the state? Could she lose custody of the child by leaving the state without the fathers permission?
What should she do to get away from him with the baby?
It is for her and the babies safety. It is a unhealthy relationship that she is in.
She is unable to post her own question for fear that her plan to leave will be found out. The fathers mother has money and could cause LEGAL problems, so she plans to kind of just disappear.
I want to know the dangers and legal consequence’s that could come of her just up and leaving him with the baby?

They were very helpful.

Even though they are not married, the father is still able to pursue legal action against the mother for taking the child without his knowledge and/or permission since custody is not yet established.

However, since the move is to supposedly ensure the safety of her and her child, if the mother is able to validate this with evidence of endangerment (domestic violence, verbal threats, etc) then the father really has no case at all.

If this is the situation, and the father takes legal action, the father will either get limited/supervised visitation, or the mother will get outright custody.

No sane family court is going to rule against a mother who is genuinely trying to ensure the safety of herself and her child.

My ex and I (not married) have split up and have a 2 year old together. She wants full custody allowing me to have child 2 nights/week. She said if I pushed for joint custody (3nights/week) she would move. I am scared of that result but want to know the law on this without paying an expensive consultation fee. Please help in NC.

I may be the biological father out of wedlock. The child will be an American citizen. Of course I’d want the child to live and be educated in the USA. The biological mother has custody rights too.
I spoke to an immigration lawyer and was told the biological mother would have to sign the form for the child to get a passport to come to USA with me.

What if she refuses?

My child, an American citizen, can never live and see and experience American life?

I am aware of the fact that the child should not have been born out of wedlock. That’s understood, but it is too late. The new issue is an American citizen who may never be able to live as an American.

Not quite true. If this father acknowledges this child as his and contributes to its support, from what I’ve read, then the child has a basis for claiming U.S. citizenship eventually. May be tricky given the stance of the mother, but then, the mother has a say in the welfare of HER child in HER country.

CHILD CUSTODY LAWS IN FLORIDA?

Ok so i was dating my ex for 4 years. we broke up about 6-7 months ago. after about 3 months that we were broken up she tells me shes pregnant with twins and there mine. at this time she had started dating another guy. then 3 months later i get a fall call from her friend blowing up on me telling me to leave my ex alone that shes not pregnant callen me names and all that. so i showed her the texts my ex sent me saying that she was and her friend still didnt beileve me. so tonight i find out she staged that to try to get me to leave her alone. now i find out she just gave birth two weeks too early with supposidly MY kids. being that i dont want to be with her anymore. is there anyway i can get joint custody? or get a dna test to see if there mine as she claims? i dont know what the child laws in florida are but someone please answer ASAP. i saved all her texts so if it goes to court i have my proof.
