If a biological mother finds out that her kids father has been to jail 2 times in the
last 6 months once for domestic violence, putting his wife in the hospital and finds out they live in a unhealthy/unstable living environment can she legally go get them because he is now only allowing very limited contact and after she gets them then, file for full custody in the state she lives in? Even though there are no legal court documents of court custody?

The first step is to report to the proper authorities the circumstances. If the mother wants full custody, then a criminal record on his part is one thing that should help her get it. Having the living conditions documented is also needed. The best interest of the children should be the key issue for any judge. It could take a little time, but work should be started immediately. Of course, this supposes that the mother is suitable, and able to care for the kids.

You are confused. The child doesn’t change anything, one of the parents has to file and then the child can tell the Judge whom they would rather live with. That age depends on the Judge, it is usually between 12-14 when the court thinks they have a right to an opinion in their own whereabouts.

Just because he isn’t legally in the country doesn’t mean he isn’t the child’s biological father with rights to that child.

You can not move out of the state that the child was born under any circumstances wheter or not you have fully custody or not even if the father isn’t on the birth certificate. You have to have permission from the other parent as well.

You can open a case for custody/visitation, sometime even before the child is born, although it usually is done after the child is born depending on how your county handles it. Now, if your child is born in Wisconsin then this state holds jurisdiction over the child and you open a case there.

so right now im raising my daughter all on my own. her father wasn’t around to sign the birth certificate because he was in jail. he has a criminal history, and he has a problem with alcohol, and he joined a gang when i was pregnant. so is there a way i can get full custody and make it he has no visitation rights? because i don’t trust him anymore. and im scared for my daughter.

It is normal in Canadian courts give first priority to the safety of the child in custody arrangements.
