If a child is not used to going with you, and you have or had a new parenting time plan put into effect that says you can take your child out for visitation, and they started crying for the other parent when you took them, did they eventually stop crying and get used to it? My daughter is 2 1/2 years old. I was wondering if anybody had this kind of experience and how it went for them?

Just keep re-enforcing the idea that you are SOOO excited to see her and that it is your turn now and that both mommy and daddy love her so much.

This behavior will stop once she realizes that you always bring her back to her mommy too, and you always pick her up when you say you will. Kids go through this with daycares too. One parent drops them off and they pitch a fit "don’t leave me, they are mean to me, i want to stay with you"…then you call in 10 minutes and they are having the time of there life, no more crying or anything.

Kids like to test you, just keep telling her you love her and miss her and get her engaged in the conversation, "I thought we should go eat somewhere special, where do you want to eat?", I got you this stuffed animal, what do you think we should call him? Is it a him or a her?"

Get them talking, then they forget they are suppose tobe pitching a fit. Also logic works really well, if she is crying for her mommy tell her "I love you and I want to spend time with you, why are you crying", then she might say "because I want my mommy", then you say "don’t I always bring you back to your mommy?….can’t we have some time together?" You know I always bring you back, let’s have some fun now."

So my friend was beat, raped and impregnated at age 17. Her rapist was put in jail for a period of time, but is now out and claiming he has rights to see his child. His name is NOT on the birth certificate, but can she still demand child support from him with a DNA test or something? And would she get full custody if he filed claims against her or anything? ANY help at all regarding anything to do with child support or custody in this situation would be greatly appreciated.

The best place for your friend to get free advice and possibly even free legal counsel is your local battered woman’s shelter. Seriously, they can push through paper work and really tell your friend their rights in your state, and help her file restraining orders, and stripping of parental rights and all of that stuff.

I have a theory that the rapist will be required to pay support while having no rights to see the child.

Child Custody state of florida?

Monday, February 22nd, 2010

Me and my ex were never married and had a child together. The father shows no want to be in my sons life and is now trying to get custody. He has violence and drugs on his criminal record. As well as no license and no permanent place of residence. He has not seen his son in almost a year by his own choice and does not contribute financially. I am sole provider of my son and can offer more than my ex. Is there any way that my ex could obtain custody of my son? Also, what would they consider in the best interest of my son?

It is extremely unlikely that he would obtain custody, especially since he has no permanent place of residence. Permanence and consistency are strong factors in considering the best interest of a child. However, this is a serious matter and you definitely need to consult with a lawyer.
