Her mom has made no effort to contact me, I have tried to get in touch with her and have had no success. I just got out of jail ,not prison, for non violent crimes I am on probation but I enrolled in college and have a part time job now, I am turning my life around.I am able to pay child support and have no objection to it. I just want to be able to spend time with my daughter. Her mom was arrested for a misdemeanor few years ago, she is an excessive drinker and smoker, I am not. She never finished high school, I do not know where she lives currently. I would suppose with her parents, or maybe her last boyfriend which I believe is an illegal immigrant or is working illegally without a proper working visa. What do I have to do if her mom is refusing to get in contact with me and obviously does not want me to see my daughter? What are my chances on getting a decent amount of custody? Do I go to the police, CPS (Child Protective Services), court? Where do I start, need help please.

Daughters boyfriend took the baby and wont give the baby back, seeking free Legal aid help or what can we do? can you provide us with some phone numbers thank you doing all we can.

I assume you’re anti women’s rights. Doesn’t she have the right to be the parent with limited visitation rights? Are you sexist? By the way, if he files for custody and ask for a jury trial, which Texas is the only state that does it, you want women completely ban from the jury as they are far more likely to rule in his favor than male jurors.

I would be very slow in introducing any women you’re dating to your children…

I’m about to have a baby, the father however left me 4 mths ago and said he wanted nothing to do with the child, there have been no girls born into his family for the past 85 yrs.. i found out i was having a girl, now his mother wants custody of the child. is there anything i can do to stop this from happening right away, and can anyone tell me my rights aswell as his rights?

Relax a bit. Unless you are unfit there is no court in this world that will just give her your baby. Unless you use drugs, abuse alcohol, live in a sty, emotionally abuse the child, physically abuse the child, neglect the child, or sexually abuse the child… she is just blowing smoke up someone’s patooty.

Go to your family and ask them for financial assistance to hire an attorney. File for child support, primary custody (allowing him some visitation) and have your attorney respond to anything her attorney sends.

Do not argue with her. And she will try to bait you. Or argue with him. Speak only to him and only about the child. Let your voicemail or answering machine pick up her calls. Hang up if he argues with you and do not answer the door to him or her at this point. Listen to your attorney. And live your life and raise your child.

Do not allow her to visit the child until you have custody on paper. She has no rights to your child. Do not give her a chance to take off with your child.

As for the father’s rights, if he wants nothing to do with the child have your attorney send him the paperwork to sign off all rights. This means you get no money but also means you never have to deal with him again. And once he is out of your life, she will eventually follow. If he chooses not to give up parental rights, he does have the right to visit/and or shared custody with his child if the judge allows. Wait for the judge to rule. And, mind what you do. NO going out, partying, dating, sex, arguing, drugs, drinking, anything that can be viewed as irresponsible. Just work, parent and live your life and they have nothing to use against you.

Because third party communication isn’t allowed would serving the other parent violate the stay away order?

The "stay away order", as you put it, means just that, stay away. It does not mean you can not have someone else serve the order, or even a sheriff may provide that service for a fee, but you can not.

There are cases where the parents share custody of the children when a protective order is in place against one of the parents. Typically the drop off location is in a public parking lot and the oldest child is given a letter to give to the other parent with any important information, like medicine instructions, or school play times.

I am in the military and married. My wife want to have her little brother come live with us, Hes 4 yrs old. Would we have to have legal custody of him to keep him? He will be going to school here, and also I would want to add him as a dependant, and put him on my health care, which is provided by the military… So basically would I have to have legal documents stating that he is in our care? or is there a way that i could do all this without legal custody?

You don’t need legal custody to "keep" him. All you need is his parent’s permission and written consent to make medical decisions on the child’s behalf, should a non-life threatening emergency arise.

However, probably to enroll him in school, and almost certainly to obtain insurance, you will need custody. If his parent’s agree, though, you can obtain a temporary guardianship order by filing a motion in family court and attending a hearing. You don’t need an attorney, just a filing fee. Pick up the paperwork at the county family courthouse where the child resides. Good luck.

Why does international child custody/child kidnapping have noting to do with children rights only parental rights even when a court in two different countries has given different rulings, conflict of law? Basically the mother has legal custody of her child in her country and is wanted for parental abduction in the child’s country of birth, because she is held there with out her fathers consent. Possession is 9/10 of the law.

The same applies to mothers bringing a child here in violation of a foreign order. Only one country clearly obeys the Hague Treaty, without gender bias, but their leader never signed it. His name is Castro.

My ex fiance and I have had trouble coming to an agreement. He move out about a month ago and now we are going to court. Our son is 5 months old, and the schedule I came up with was he picks him up when he gets off work which he would arrive at about 6pm on Mon. Wed. and Fri. and I’d pick him up at 10pm and he’d get him every other Sat. from 3pm until 10pm. Then after he turned a year old he could have him every other weeken from Fri 6pm – Sun 6pm Since I plan to be through Breastfeeding by then.
His plan however his him get him one week then me the next. Which I don’t agree with for many different reasons. Including I don’t see why he would send him to daycare if I’m able to take care of him.
Anyways, my question is how likely do you think it would be that the court would agree with either of those plans, and if not. What type of plan does the judge usually come up with?

my ex has agreed to give me full custody of our 2 yr old daughter (since his fiancee is pregnant he agreed) however we dont want to have to go to court and all the drama it includes is there any way we can do this in a civilized manner where he just signs the papers maybe with a lawyer to witness and we can go our separate ways… i honestly dont want the chaos of courts and lawyers and i dont want to file for child support i can support her with out his help beisdes hes got one on the way… he can barely manage to support him self.. any info helps thank you!!

It would not be legal without a judge’s signature, but you don’t need attorneys.
