Child custody agreement in Texas?
Thursday, September 30th, 2010My wife and I are getting a uncontested divorce in Texas. We have one child and I am a fireman working a 24 hour on 48 off schedule. We have been separated for 2 months and have worked very well sharing custody and expenses for our son. She told me we are not required to have a custody aggreement and she is very happy with the way we are handling custody. Is this legal? We do not want to throw what little money we have to the lawyers.
It is certainly legal, but may be illadvised. If a dispute arises in the future, you may have to modify the court order.
Some judges are very reluctant to approve a divorce decree that does not include custody and visitation terms.
