I am a father of three boys.  I have one of them living with me as his mother had some “issues”.  I am the one with parent custody (placement is the actual correct term here). The other two are living with their mom and I haven’t seen them in about a year and a half due to her new husband and father in law both being lawyers and some mistakes in dealing with her on my part.  So obviously in this case she is the one who has parent custody.

One of the problems that I have seen in this system, which has worked both for and against me, is that unless you can afford a lawyer, your rights usually are not enforced.  This is something that can be good and bad, but will rarely take into account what is best for the child or children.  If both parties are reasonable, they can usually work things out, even if neither is entirely comfortable with the end result.  This is usually when both parents are looking out for the child as opposed to their own self-interests.

The flip side of this is that one or both parties are not reasonable.  This is far more common, and will usually end with either the person who is able to best afford the lawyer getting their way, assuming it’s not totally outrageous, or an ongoing legal battle in which the children become pawns.  Neither of these options are good for the kids more often than not.

People need to learn to drop their agendas, their personal hurts, their own selfish wants and whatever bad feelings are left over for the sake of their kids.  This in and of itself would solve a lot of issues when it comes to the parent custody issue.  Think about it, and then think of your kids.  It can make all the difference in the world.

My daughter’s father and I are going to be drawing up the paperwork for joint custody. We get along very well and there is no issue about this. Someone told me that one of us will have to pay child support, but if everything is split evenly, why would that be necessary? I’ve tried to research it to no avail. Any help would be appreciated. Thank you.

With out knowing what state you are in, can not answer.

What papers do I need to file for custody of my 2 kids. The clerk of courts in my county does not supply them…

I have a 3 &4 year old that I have had full time for the last 15 months. There mother moved away 12 months ago and has not seen them since, not paid any child support, and only calls every 3 weeks. She has 2 felony drug charges, Had 2 DCF cases against her, been in 3 inpatient drug rehab, and had her oldest daughter (not mine) takin away from her.

I have a job and a stable place for them. No legal trouble what so ever

Is there a chance she will win if she fights me.

FINALLY, A NON-DUMB FATHER!!!

I would be rich if in the last 23 years I had a dime for all the times I hear about a mother have doing this, the father DOES NOT file for custody, or PARENTAL RIGHTS as single fathers have no presumed rights to their children, she comes back, takes the children away, and files for retroactive child support.

Simply contact a Doc Prep Service in your area. Tell them exactly what you need, and they will prepare the documents for filing. There are also a few online.

Here is the Dads House Manual which can also teach you how to hire an attorney. You can reduce the cost of hiring an attorney through preparation and taking the time to interview attorneys. A less experienced (Cheaper) attorney willing to take payments, but employs an experience paralegal can be as effective as an more experienced and expensive one, The paralegal is the real backbone of any case. Often when an attorney dies or retires, their paralegals will go to work for a young, new attorney to guide and help them gain experience.

What are the steps to give the other parent custody of children? I receive child support from that parent, we dont want to get lawyers involved,we both agreed to the custody change, who do we have to inform or what paperwork has to be done in order to stop child support from being given to me, and to have the children under his name? Im from Georgia hes from Florida

if he is the biological father you don’t need custody papers, all he needs is there social security cards. unless he plans on getting child SUPPORT from you. your the natural parents, your in agreement why do you need something in writing. but you can go to the county court clerks office, and they will tell you where you can get the change of custody papers, and child SUPPORT papers, called a abstract
