I have always heard the court system is bias in favor of the woman in many cases however what are circumstances in which sole custody will be awarded to the father?

When it is shown to be better for the child. It happens a lot more than you think. Most of the time, it’s shared custody, so both parents share in the custodial duties instead one just having custody and the other visitation rights.

My wife and I are separated, and we work out custody to both of our benefits. She works nights, and usually has her days off (3 or 4 days) in the middle of the week, so those are the days she has the kids. The other days, I will have the kids. We both have custody, and it works out great (not as great as if we were still together, but as great as we can make it under the circumstances).

When they live in another country? The child and custodial parent live in the US? What would help the non custodial parent win to get custody?

The only way is to prove that the custodial parent is an unfit parent. And petition the courts for custody.

WE HAVE LAWS PROTECTING CHILDREN AGAINST CHILD ABUSE, EXPLOITATION AND DISCRIMINATION BUT WHO ENFORCE THEM?

Section 1. Sec. 2 of Republic Act No. 7610, as amended, otherwise known as the “Special Protection of Children Against Child Abuse, Exploitation and Discrimination Act”, is hereby amended to read as follows:

“Sec. 2. Declaration of State Policy and Principles. – It is hereby declared to be the policy of the State to provide special protection to children from all forms of abuse, neglect, cruelty, exploitation and discrimination, and other conditions prejudicial to their development including child labor and its worst forms; provide sanctions for their commission and carry out a program for prevention and deterrence of and crisis intervention in situations of child abuse, exploitation and discrimination. The State shall intervene on behalf of the child when the parent, guardian, teacher or person having care or custody of the child fails or is unable to protect the child against abuse, exploitation and discrimination or when such acts against the child are committed by the said parent, guardian, teacher or person having care and custody of the same.

“It shall be the policy of the State to protect and rehabilitate children gravely threatened or endangered by circumstances which affect or will affect their survival and normal development and over which they have no control.

“The best interests of children shall be the paramount consideration in all actions concerning them, whether undertaken by public or private social welfare institutions, courts of law, administrative authorities, and legislative bodies, consistent with the principle of First Call for Children as enunciated in the United Nations Convention on the Rights of the Child. Every effort shall be exerted to promote the welfare of children and enhance their opportunities for a useful and happy life.”

Filipino Children in Nation-Building
Posted by Online on Jan 24th, 2012

Manila, Philippines — FILIPINO children are the nation’s future. Advancing their cause is not only the concern of government, but everyone’s. They should be protected against all forms of discrimination and provided with access to health and education through holistic and sustainable strategies facilitated by inter-agency as well as public-private partnership.

The Local Councils for the Protection of Children (LCPC) was created to coordinate the efforts of public and private entities in promoting children’s rights and implementing child-centered programs on the local level.

Records showed that 83 percent or 36,527 of the total 43,279 local government units (LGUs) have organized or reorganized their LCPC 55 on the provincial level, 114 on the city level, 1,195 in municipalities, and 35,163 in barangays.

An agreement was forged between the Department of the Interior and Local Government (DILG) and the World Vision Development Foundation to promote children’s welfare by enhancing the LCPC in the communities. An LCPC program, in coordination with the Council for the Welfare of Children (CWC), is to ensure that child labor is prevented within the communities. The CWC is the lead agency in promoting and safeguarding the rights of children.

Every step must be taken to uphold the rights of Filipino children, a vulnerable sector of Philippine society. They must be recognized for their important role within the family and in nation building. All sectors, including private groups and individuals, must continue to support government endeavors to safeguard the well-being of children….READ MORE

Minnesota divorce and family law lawyer and attorney, Adam J. Blahnik of Blahnik Law Office, PLLC, in Prior Lake, Minnesota discusses the impact of physical custody and legal custody labels on child support in Minnesota.

As a Minnesota divorce attorney, Mr. Blahnik “wears many different hats” depending on the circumstances. If there is hope that the Minnesota divorce proceedings will get resolved through mediation or other alternative dispute resolution methods, then Mr. Blahnik wears the hat of an amicable attorney in the hopes that the spouses can resolve their differences without it costing them their life savings in litigation fees. However, once it becomes obvious that there will be no stipulated agreement in the Minnesota divorce, then Mr. Blahnik will vigorously advocate for the rights of his clients in Court. Mr. Blahnik is an experienced Minnesota divorce lawyer and litigator and will fight for the rights of his clients until results are reached.

Mr. Blahnik understands that many of the legal matters that his clients are dealing with are stress induced and can be quite overwhelming for many. Because of this, and specifically with divorce, child custody and family law matters, Mr. Blahnik makes himself available to clients throughout Minnesota (MN), and specifically in Prior Lake, Scott County, Dakota County and the Twin Cities. Contact the firm by telephone or by email potentially 24 hours a day, seven days a week.

Adam J. Blahnik received his Juris Doctor degree from William Mitchell College of Law in 2005, and was admitted to practice law in the State of Minnesota in 2005. Mr. Blahnik is also licensed to practice before the United States District Court, District of Minnesota.

Mr. Blahnik has given an accredited legal presentation on the Uniform Child Custody Jurisdiction and Enforcement Act, “UCCJEA Basics in Minnesota” at a family law seminar on February 12, 2008.

Mr. Blahnik is a member of the Minnesota State Bar Association and a member of the family law section therein. He is a member of the Eighth District Bar Association, which covers Scott County, Carver County, Le Sueur County, Sibley County and McLeod County. In addition, Mr. Blahnik is licensed to practice before the Tribal Court of the Shakopee Mdewakanton Sioux (Dakota) Community in Prior Lake and the Tribal Court of the Prairie Island Mdewakanton Dakota Community.

Adam Blahnik is a Minnesota divorce attorney, Minnesota divorce lawyer, Minnesota child custody lawyer and attorney, and focuses on divorce and family law in Scott County Minnesota and Dakota County Minnesota.

With Custody

Tuesday, February 7th, 2012

To learn more about “With Custody” please look at http://RealHere.com/with-custody
Please—we do not want to hear these words from YOU…it’s much easier to win the first time around then to re-open your case later.

If you are presently involved in a child custody dispute (or might be involved in one in the future) we have identified information of great importance that you should have.

THIS INFORMATION WILL HELP YOU, AS A FATHER, MAKE YOUR STRONGEST CASE FOR CUSTODY. It will also directly help protect your children now and in the future. Your children will thank you one day for taking “their best interests” seriously!

First, we would like you to know how we have come to be in possession of so much important information. Over the 30-plus years of our working in the child custody field, we have become increasingly involved in cases that frequently may find their way into court. We have acted as expert witnesses, custody evaluators or consultants for hundreds of parents involved in custody disputes all over the country.

Further, as editors of a national publication on custody matters, as responders to a 24-hour “hotline” where we answer questions from professionals about our tests, and as directors of a national organization of custody experts, we continually hear from judges, attorneys, professional experts and parents who in one way or another have been caught up in custody disputes, some of them simple, but most longstanding, complex and bitter.

As a result of all of these activities, we came to gather a huge amount of information on how various psychological and legal strategies, different kinds of evidence, and types of allegations work (or fail to work), both in the courtroom as well as in out-of-court negotiations.

The following are some of our thoughts on what we have experienced. Everything discussed here is covered in our new Strategies handbook.

We were shocked at how many bright, wise, loving—indeed even “savvy”—fathers did not know the single most important fact that must be true if one is to prevail in a custody dispute. And this must be the best kept secret in the world, because even extremely intelligent, sophisticated professionals fail to make use of it. Indeed, even attorneys, who themselves as parents are caught up in custody disputes, frequently do not know how to make his single most important factor work for them.

We identified fourteen “key behaviors” that differentiate between parents who do well in custody disputes from those who do not. We consider these behaviors to be strategically critical.

We have identified what we see as the single biggest mistake a father in a custody dispute can make. And the irony here is that our own legal system actually encourages fathers to make this huge mistake.

If you are a father in a child custody dispute, you must learn to recognize (and deal with) blatantly wrong and immoral strategies that will likely be used against you. To add insult to injury, these strategies can be effective. And in our experience, many attorneys fail to help their clients deal with these tragically effective strategies, because they are more psychological than legal strategies, and attorneys are not often trained either to recognize or deal with them.

Another exceedingly important point is that too many fathers do not fully understand all the important things their attorneys should be doing for them. Simply put, many fathers do not know what they should ask for.

While on the topic of attorneys, we also discovered two important strategies that will literally “force” an attorney to do a better job for a client.
