what are my child custody rights in california?
my gf of 7 yrs hit me with a temporary restraining order which also gave her tempoary custody of our 3 kids. Is my only hope of getting full custody restored based upon who files for custody first?- given that I can prove the kids are in my care at least 50% of the time and that she works odd hours and basically cant provide adequate child care while she works??
You need to retain an attorney specializing in family law. The issues of child custody, visitation, child support, and so forth will be decided by the court based upon evidence presented and witness testimony.
Be careful about attacking the credibility of the other parent in court. You must be able to factually substantiate any claims that you make or risk looking like a bitter and angry person. Such attacks often backfire and end up damaging the credibility the attacker rather than the intended target.

If you are asking what your chances are of getting custody–no one can answer that for you here. You need to get yourself a lawyer, though, or your chances will be close to zero.

The order in which people seek review of custody means nothing. Once you prove paternity, the court will decide custody and visitation based on the best interests of the children. The court will consider what you said about the gf, as well as whatever led to the restraining order, and all other relevant evidence.
