Yes, the biological father has the right to take his children anytime he wants unless there is a court order preventing him from doing so. If your grandmother and sister want to fight him, they need to see a lawyer right away. But, unless he is proven to be an unfit parent he will likely win.

Focus on the very point you have made here in your question!!…Here in the UK,If a parent has not lived with or had regular contact with a child,especially from birth then they do actually sacrifice some of their parental rights and have to fight through the court just for access to see the child.
You need to prove that her ex has not been around since the baby’s birth,has not contributed financially or anything,playing on the fact that her daughter would simply view him as a ‘stranger’ as opposed to ‘father’..and that in light of this you all feel that it is far from in the best interests of the little girl that contact be forced!.
Im not sure how much the US law differs but I would not worry too much,I shouldn’t think you will have too harder case proving the above!.
Here in the UK..You would have more rights to the little girl having been the one that she knows and has formed a relationship with..After all..being a Dad is in the actions not the name!.

Nobody can say yes or no to this question, every case is different but the fact that he’s illegal would probably not go in his favour, particularly if there was a threat he might remove a US citizen from US soil – American courts take a dim view of non-American parents removing their citizens from the country

Get yourself a really, really good (and preferably nasty) lawyer & let him/her frighten the sh*t out of your ex

I’m making a lot of judgements here but if you were a really bad, neglectful parent he wouldn’t tell you he was going for custody he’d just do it, what he said is the mark of a nasty, manipulative creep, who’s trying to control you even after the relationship is over – if this is the case build up your support network, make sure they know what’s going on & get a lawyer to ensure you follow every legality correctly

edit: don’t report him & get him deported, you want him right in front of you where you can see him & know what he’s up to

When i got with my girlfriend she was pregnant and wants nothing to do with the biological father. He didnt want anything to do with her and the baby until he heard i was in the picture. We had everything running perfect and i was ready to step up and be his father. The only reason he is doing this is to be territorial. We dont know how to make it so he cant get any sort of rights.. suggestions?

Once he understands that his paternity rights also include paying child support, he may change his mind about wanting to be involved with the child. So just be patient.

I just filed for U.S. citizenship using the N-600. I know i am a citizen because my father was naturalized while I was under 18 yrs. However, he and my mother were never married, although both there names are on my birth certificate. Now immigration wants to know if he had legal custody of me . My mother died in Haiti when I was 2 yrs old, but i have no death certificate. My father and I have lived in America since 1993.

Were there any school records that he signed, or that listed him as your contact?

Can you contact Haiti and get the birth certificate? If she died in a hospital, can you obtain hospital records?

Did anyone hear about that news article about that boy who accidentally got taken to an Italian orphanage when his mother kidnapped him from his father who is American, and the Italian community took him to the orphanage when they found out that the mother was too ill to take care of him properly , and the father is American and has legal custody of the boy, but the Italian orphanage will not release him? Has this been resolved, what happened?

I know exactly what you’re talking about. I do remember seeing the father on Fox and Friends one morning, a few months ago. From what I recall, he IS getting his son back (or has already gotten him back). I can try to dig up some links, but I don’t know if I’ll have any luck – I didn’t see many programs pick up that story.

You are the biological mother then you have have full custody of your child- if you want full custody to where you don’t want the father to have any control then I would check with family courts. Let them know that the father is not involved in the childrens lives. He is not there for you financially, he comes around unexpectantly and then leaves you with no contact information, no money for the child. If your going to do this I would also, keep record of all your financial dealings with your child.
Keep all your reciepts every thing you buy for your child, medical bills, doctor appointments, keep record.
If your child is in school make sure you keep record of your childs report card, statements from your teachers about your childs. Keep everything you have on your child it will be your proof that you are caring for you child. And he will have nothing to show that hes taking care of his responsibility.
