Leaving the State with Joint Custody

San Diego divorce attorneys, Elizabeth Brown and Michele Lowenstein, discuss leaving the state while on joint custody. The lawyers explain that the dissolution of a marriage with children includes a parenting plan in which a provision decrees that it is prohibited to change a child’s residency outside of the state of California without a mutual agreement between both parties or a court order. This court order weighs many factors, including how attached the children are to each parent, the age of the children, and the children’s continuing contact with both parents.

Where the court will ultimately go is unpredictable. There are, the two divorce lawyers warn, no guarantees. The determination of the court will be made based on what the California court considers to be in the best interest of the child.

I live in Arkansas and I am in joint custody. My dad is primary and my mother is secondary. My step mom is stealing money from me, and has dishonored certain visitation rights and I wish to live with my mother who is married and has a home and is able to care for me just as well. In other words, do I by default am the primary custodial parent because I have my son 65% of the time even though it is considered joint custody. OR am I the primary residential parent with only more time and less child support to pay.

You have nothing as you were not married to her, so it doesn’t matter. You better move on this and get something filed.

I was wondering what the guidelines were pertaining to Joint Custody in Arkansas. If the parents of the child were to have joint custody, such as one parent has the child on the weekdays and the other on weekends or whatever the arrangement may be, if the parent, in particular the father would have to pay child support still? If he were to help pay for expenses such as school supplies, clothes, etc when the child gets older and have partial custody if they would have to pay child support?
Or if the mother does not want the father’s money…will the state mandate child support? and if they do not…if later on the mother decides she wants child support from the past years could she get it even though she asked not to get it in the first place?
Anywho…my main question is..In Arkansas, if parent’s have joint custody, would the father still have to pay child support?

Dependent on the amount of time each had the child, plus remember time in school and daycare would be deducted, on a basic equal time, it would go by the difference in their income, rather than specifically his. They should consider Bird Nest Custody and a Trust Fund.

Asahi Broadcasting Corporation (ABC) televised a short 14 minute piece on Joint Custody (Kyoudou Shinken) on June 8th. It was a short but good program aired in Osaka that focused on 2 women. One woman can only see her kids 4 times per year when the kids spend the day at her parents house. The other woman’s children are in America (Utah). Since Japan has not signed the Hague Convention on the International Aspects of Child Abduction the father will not let the children visit Japan. She would like Japan to sign the Hague so her kids can come to Japan and visit and learn about Japanese culture. ABC said they would do more stories related to this issue in the future. Hopefully, they will continue their series on “how to help children”. Please watch the two part video. Two lawyers and some other parents also voice their opinions in the video.

Right now we have custody as agreed upon. He is supposed to pay 200 a month, but is a month behind. He refuses to pay it. Now he says he is going to get joint physical custody and not have to pay child support at all.

Sole custody fathers still have to pay.
