I am a father of three boys.  I have one of them living with me as his mother had some “issues”.  I am the one with parent custody (placement is the actual correct term here). The other two are living with their mom and I haven’t seen them in about a year and a half due to her new husband and father in law both being lawyers and some mistakes in dealing with her on my part.  So obviously in this case she is the one who has parent custody.

 

One of the problems that I have seen in this system, which has worked both for and against me, is that unless you can afford a lawyer, your rights usually are not enforced.  This is something that can be good and bad, but will rarely take into account what is best for the child or children.  If both parties are reasonable, they can usually work things out, even if neither is entirely comfortable with the end result.  This is usually when both parents are looking out for the child as opposed to their own self-interests. 

 

The flip side of this is that one or both parties are not reasonable.  This is far more common, and will usually end with either the person who is able to best afford the lawyer getting their way, assuming it’s not totally outrageous, or an ongoing legal battle in which the children become pawns.  Neither of these options are good for the kids more often than not. 

 

People need to learn to drop their agendas, their personal hurts, their own selfish wants and whatever bad feelings are left over for the sake of their kids.  This in and of itself would solve a lot of issues when it comes to the parent custody issue.  Think about it, and then think of your kids.  It can make all the difference in the world.

My parents have been foster parents to my little brother since he was five days old. Now he is two years, five months old. We just received word that custody is being given back to his biological mother. Can my family do anything to keep him in our home?

If they have deemed her fit to have custody then there probably is not much you can do. Custody always goes to the mom unless she is unfit or gives up her rights. However you should talk to an attorney about this to be sure. Also discuss with the attorney if you can legally keep track of him in case the boy goes back into foster care to make sure your parents get him. That is what I would do. People in here are not going to know the law.

Is it fair that one parent get custody of a child and the other parent has to pay child support even if he/she wants custody? Is it fair that because of this there are many women that can’t find a husband and can’t find a man to have sex with because to many man do not think it is worth being a father to this arrangement. Man only want children if they can have custody and do not have to pay child support. Is this fair yes or no?

Totally not fair.

My parents have joint custody over me but because of some family issues i want to go and live with my aunt. My parents have joint custody and my dad doesn’t want me to go and live with my aunt could it be legal if we just had the agreeing signature of one parent or do we need both parents to sign over custody

I am no lawyer but I think you would need both. He is still in control of you in joint custody and he doesn’t have to give it up unless a judge makes him.

Does it go by:

1. The state that the mother resides in, the state that the father resides in, or the state that the divorce and child support order occured? Or is that not relevant at all?

2. Or does it go by the state in which the parent seeking full custody resides in, can that parent initiate in their state before returning a child back to their other parent at the end of their visitation if an injunction is filed?

Answers with legal proof/precedent cited, no opinions, please.

How old are you when you are allowed to choose which parent to live with? I ask this because I know 3 sisters who live with their mom, but their dad is trying to get custody, but they hate him.

depends on the state you are in. some states say around 12-13 years old. However, the child never ever has the TOTAL choice in the matter. The courts have the last say; depending on what they say is best for the child!
