If the father of a child and the grandparents share joint custody of a child and the father becomes incarcerated. He gets married after the joint coustody was established. Who has legal custody of the child? The grandparents or the step mother?
Whatever is legally written down and unless the new wife adopted the children-she doesn't have a horse in this race.
The father and the grandparents will have to decide this.

The grandparents, unless the stepmother was added into the custody decree or she adopted the child. She has no legal claim on him or her otherwise.

This is probably one for Social Services (unfortunately, because some of them can be draconian, and others totally ineffective). If you are in the UK, I suggest you go to the Citizens Advice Bureau about this – they have access to information on virtually anything. I'd say the grandparents, but a lot depends on their track record too.
