Can I get Primary Child Custody if the father is not around?

I’m a single mother and not married to my sons father. We broke up 3 years ago and ever since he hasn’t been there nor physically or financially. I don’t know where he lives, I don’t know his phone number. I know nothing of him, But every once in a great while he comes to see my son and then disappears again. I know he doesn’t want anything to do with the law and he will not show up to court for sure. So I want to know what are my chances of getting Primary Child Custody?

You are the biological mother then you have have full custody of your child- if you want full custody to where you don’t want the father to have any control then I would check with family courts. Let them know that the father is not involved in the childrens lives. He is not there for you financially, he comes around unexpectantly and then leaves you with no contact information, no money for the child. If your going to do this I would also, keep record of all your financial dealings with your child.
Keep all your reciepts every thing you buy for your child, medical bills, doctor appointments, keep record.
If your child is in school make sure you keep record of your childs report card, statements from your teachers about your childs. Keep everything you have on your child it will be your proof that you are caring for you child. And he will have nothing to show that hes taking care of his responsibility.

    Unless there’s a court order in place on this, you already have sole custody due to the standard bias against single fathers. No single father has parental rights until awarded them.

    your chances are very good but I am confused you know nothing of him yet he comes around now and then. You mus know his full name. is he on the child’s birth certificate?
    paternity suit could be done.
    just go to family law court and file the proper paperwork or use an affordable attorney to establish full custody so no problems come up down the road.

    Doesn’t matter if he doesn’t show or not. There will be an attempt to locate him with any info you have of where he last lived etc. Same goes for child support. You would provide child support with as much info as you have on him and they will locate him if possible. If he fails to show to court, well they will try their best to find out what his income is and establish child support that way. Same with custody, if they cannot locate him, they will grant you custody, and may possible grant him some type of visitation order if/when he ever shows again.
