can my daughters illegal father win custody of my daughter?

My daughters father is threating to take custody of my daughter…but he is illegal. Can he still try to take custody of her?

Nobody can say yes or no to this question, every case is different but the fact that he’s illegal would probably not go in his favour, particularly if there was a threat he might remove a US citizen from US soil – American courts take a dim view of non-American parents removing their citizens from the country

Get yourself a really, really good (and preferably nasty) lawyer & let him/her frighten the sh*t out of your ex

I’m making a lot of judgements here but if you were a really bad, neglectful parent he wouldn’t tell you he was going for custody he’d just do it, what he said is the mark of a nasty, manipulative creep, who’s trying to control you even after the relationship is over – if this is the case build up your support network, make sure they know what’s going on & get a lawyer to ensure you follow every legality correctly

edit: don’t report him & get him deported, you want him right in front of you where you can see him & know what he’s up to

    Yes but he will be sent home before court starts and have to negotiate from there, which will be near to impossible.I wouldn’t worry.

    No, he can’t & once he’s been reported for being illegal, he will be deported out of the country. If he is here with a valid Green Card, it may complicate things, for you, unless his card has expired. At that point, he’s illegal. If you don’t have a lawyer, hire a darn good one to handle this case for you.

    yes he can, but usually the courts side on the side of the mother, even if he had papers u would have to be a drug addict or abuse ur children in order for him to win. I know of an illegal immigrant that has custody of his son, i dont know how much of a fight the mother put up, but shes not the classiest person.

    He can still get custody even if he illegal. and if you call i.c.e. they are not going to come to your house to pick him up. They will actually do noting. and when you go to court they judge will not ask if he is illiegal or not.

    You do what’s right for the child. An illegal alien is a flight risk. I’d start researching Hague Laws, Uniform Laws (UCAPA, UCCJEA, etc.), child’s best interest factors, etc.
