Can my sons father take custody or keep me from joining the navy, even if im married?
My sons father and i never went to court for custody. We went to mediation for visitation but he never stood my the agreements, he never took him when he was SUPPOSED to. I plan on getting married to my boyfriend and joining the navy. My question is could he take custody because of this, or will i not be able to join because he has visitation, or will it just need to be revised? He pays childsupport if that has anything to do with it.
Naturally as the baby’s father he can sue for custody at any time for any reason…..your defense is strengthened by the fact he does not maintain a presence in the baby’s life like he agreed to…. he does not visit when his son is available ; why should he object to your son not being readily available.
His suing for child custody should not impact your enlistment in the Navy.
My recommendation: Get married….have your new husband adopt the child…(this will terminate child support obviously…. meaning your ex will be inclined to support the action)…. then get on with your new family and your new life

I think you should call the child support office at your local courthouse, or your local attorney general’s office for the state, or ask to speak to someone in the navy that can steer you in the right direction to answer these questions.

You will likely have to go to court. Initiate the proceedings now, otherwise he may later, and then you’ll be stuck with the consequences afterward.

You may join, he may still visit or you send your child for visits…
