Can the biological father get custody if another man signs the birth certificate?
When i got with my girlfriend she was pregnant and wants nothing to do with the biological father. He didnt want anything to do with her and the baby until he heard i was in the picture. We had everything running perfect and i was ready to step up and be his father. The only reason he is doing this is to be territorial. We dont know how to make it so he cant get any sort of rights.. suggestions?
Once he understands that his paternity rights also include paying child support, he may change his mind about wanting to be involved with the child. So just be patient.

Well he will always have rights. You can put your name on the birth certificate (or no name) but he could demand a paternity test and if he was the father, he could then demand custody or visitation. But he would also have to pay child support – and he may not want to do that, so he may agree to you legally adopting his child.
You could try just telling him that you are the biological father, if he believes this he would be unlikely to seek a paternity test.

if he is the biological father, your gf needs to get child support. not having his name on the birth certificate doesn’t mean anything. If you have not been married to this girl for a year there is no way you would be able to adopt the child anyways. The most important thing though is that maybe you are being territorial and over-protective, and he just wants to be a part of his childs life. you would do the same thing. the bottom line is that if he loves her, that is just one more person in the world that does and there is nothing wrong with that.

scary thing is…if a court found out that you knowing put someone name on the birth cert who isnt the actually biological father/mother it is a criminal offence and people do go to prison for this for a while. So be careful there. Although i dont really know much about this..i think you have to either put the real father or leave it blank. He’s always got rights because he could ask the court (if it went to court) to do a dna test to prove that he is the father and obviously when it is confirmed he is the father, im sorry but you wouldnt have a leg to stand on. Dont want to sound harsh but its the truth. Sorry.
