Father of son wants custody since mother is in jail?
Father is non abusive to son and is very supportive of his son’s concerns and education. The son is 14 years old and has been through a lot while living with mom. Since he has been spending time with his father, he has a better attitude and is more interested in his education. He currently is living with his aunt (mother’ sister) since the mother had custody, but his father picks him up on the weekends. He enjoys interacting with his father. Will the father have to get an attorney or can he just file the paperwork himself.
file the paperwork yourself, at age 12 most children can choose witch parent they want to live with, it sounds like MOM is current UN_FIT to parent and the father is very involved, the young adult can in writing send his wishes to the court to be read for the record.

It is always better to have a lawyer. At the same time if the mother is just dumping the child off at the aunt’s you might have a chance. there are men’s groups. Google it where you can get support and maybe a lawyer pro bono. Keep fighting for your child! No matter what happens, they will know.

The father should consult and attorney and find out what he needs to do to file for custody. A child should be with his/her parents. Any judge would agree with that.

To be on the safe side, I would speak to an attorney because the Aunt might decide to fight for custody. Since the boy is 14, he is old enough that a judge would ask who he wanted to live with and he could choose who he wants to live with.
