how old do the boys need to be before their father takes custody?
a friend of mine has two little boys, one 5 and one 4, he doesnt have an official divorce with his ”ex-wife” but he doesnt live with them anymore,he loves them deeply and wants to take custody but is there any law that says how old the kids need to be when they are taken by the father?
At that age i think they would be able to live with there father.

if there not divorced then he can’t untill they choose to live with him at about age 16-18, he should file for divorce.. if he cant see his kids and still married she can get in trouble

if he can prove she is a unfit mother the he may have a chance to get the kids but if he cant then that judge is going to let the mother have them. its that way in all 50 states . a child may belong with their father but the way the law sees it, they belong with their mother more.what he knows and what he can prove on her are two different things.

He needs to go to court and prove that he can take care of them better than where they are now. He must have a job, a home, someone or something (daycare) to take care of them while they are at work. He needs character witnesses for himself and some that will speak to the court about the mother not being a proper parent. He must prove she isn’t doing a good job. The judge will not care about the age of the child. He/she is only interested in having the children in the best place to have the best life.

I do not believe there is any age that a child must be for a parent to get custody.
As stated above they would have to actually be divorced.
If there had to be an age, that would be silly when you think of it considering some people are just never fit to be a parent even though they are able to create a child.
