What can be done for the father to get custody of his son?

Both parents are 17, but the mother of the child is moving out of state with another family member and taking the child with her because the father does not want to be with her, but he wants his son. They have never been to court for custody rights. What can be done to stop her?! Just last month and this month she didn’t even want the child and gave him to the father, but recently has taken him back and is saying she is not giving him back. Help please?

He needs to immediate file an injunction with the court to prevent the move of the child pending a full court hearing.

    To get legal custody, he needs to take her to court. However, since she doesn’t have full legal custody either, she doesn’t have the right to take the son so far away and not allow the father to see him.

    He needs to go to domestic relations and file a custody order. They will have to go to court and she will not be able to move out of state unless he agrees to it. Tell him call immediately, because if she moves you may have a really hard time getting her to come back at all, especially if you don’t have an address for her.

    If he is the legal father then I dont believe she can take the boy from the state where the father lives without his permission. Each state has different laws but I believe that most of them are like this.

    Hire a Lawyer ! Quick ! Do not delay ! If you want the child to be a part of your life you need the Court, on your side. You will have to pay Child Support ! Be a man ! Stand up and be a responsible person, and citizen

    Courts will not remove an infant from the mother. Since he hasn’t bothered to go to court he really has no rights. He should have gone to court while she was still pregnant, then at least he could prevent her from moving out of state. Now it is too late, because first he has to get a lawyer, file for visitation and go to court will take at least three months and no doubt by that time she will have already moved. The only thing he can do is get a court order of visitation and he will have to pay all costs in going to visit his child out of state…plus if SHE is smart she will file for child support…I suggest you son gets a job.
