I’m an American and my French girlfriend is pregnant by a French man in France. We have been together for almost 3 years before this happened. She have been pregnant for 4 months now. We are still deeply in love and want to get married. I have so many questions about this situation. Can she gain entry into America while being pregnant? When we are married, can the father win custody if the baby is born in America? Where can I find pregnancy immigration laws on situations like this?
She could become a US citizen after you are legally married for 2 years. The baby would not be born a US citizen because his mother will not be when its born, but may become one later, once its mother is, if she has custody. Its father can definitely win custody. To know his odds, you would have to know a few things about the parents and the way they deal with this stuff in France and I don’t know about that so that’s all I can tell you.

For a problem like this you need a lawyer my friend- and a good one. If you intend to be the baby’s father (raising him/her) it is to much to risk on anything but a professionals advice. good luck.
