The only time a father gets custody is if :
He is so rich and powerful that the mom doesn’t stand a chance in court.
The mom really doesn’t want the kids.
The mom is a horror show. ( drugs , crazy, etc. )

Yes, they are more likely to be granted custody (or residence, or whatever the notion is in your jurisdiction than men.)
Courts in different jurisdictions will make the decisions for different reasons. Some jurisdictions do have a ‘tender years’ doctrine, which is the assumption that young children are better off with their mother than their father.
However, the more normal reason for women being more likely to get residence is because the women are more likely to be the primary care-givers for children, and the courts will make a decision based on the welfare of the children.

In uncontested custody cases (ie where both parents agree) the woman gets custody 70% of the time. Where custody decisions are contested (ie, they do not agree) men are awarded custody between 51 – 63% of the time

Most men do not want custody. So, yes, women get custody more often- however when men do want custody, and there is full court trial, they win the majority of the time.
I know this is just an unusual situation BUT I saw a real injustice to three children when this happened once. Mom had to flee because of abuse- she filed and got temporary custody and a temp support order that dad never paid. However, during the same time he contributed over $9,000 to his ‘church’. Mom and kids had to live in bad area simply because they could not count on any support from dad. The judge thought she should have provided a better living arrangement and gave him custody.
He took the kids gave them to his church members he really did not want them. He just wanted control- he felt she would come back to him if he had the kids. CPS took the children from the church (cult) because of abuse. This church felt corporal punishment was right for all situations including potty training. The kids came back to mom and court reversed all prior custody orders. He is paying support since its a permanent order and they garnish the checks.
I just got a graduation announcement for the oldest child, He is graduating with a nearly 4.0. She never kept him from the children either. But she did have a bar to him having them around his church.
I’ve also seen plenty of women who got their children when they were totally unfit or became so. There should be test!
EDIT: Don’t put words in my mouth. Nowhere did I state that the men were drug addicted slugs, didn’t love their children, etc. Most men aren’t and do. But right above me I believe it was Eleanor who posted the %’s and they are right.
Most men don’t think they can parent as effectively as their soon to be ex-wives. My husband did plenty of divorce cases. Most of his male clients did not want custody- and some of the women as well. A couple of cases neither wanted them (I wonder about those kids now).

But actually Professor, your assumption that over 50% of dads dont want custody is a little unfounded.
For example, in Israel, 98.5% of custody cases has the mother as the primary caregiver, i’m not so sure that 98.5% of divorced Israeli dads are drug addicted deadbeat shlums who didn’t want their kids.
Every father that i’ve personally met loved his kids and saw them every chance he got if he was divorced.
That is not to say that there aren’t deadbeat fathers, there are TONS and TONS of them, but saying that "most" men dont want custody is just overblown

Unfortunately, yes. But i was lucky.
It came to caught, my dad and his partner came up with a folder full or reason after reason as to why me and my brother should stay with them.
The whore who pushed me out (and i was heavy, glad i gave her the pain) said that the reason shes deserved ‘her’ kids was ‘Because i’m their mom’.
What thicko.
I’m so happy i live with my dad.

If the majority of prison inmates were raised by single mothers, it’s because their fathers abandoned them intentionally, or abandoned them by being incarcerated. It’s not something the mothers chose. That’s a pretty lame argument for not giving custody to a mother. I believe what’s best for the child is shared custody. But if one or both parents is too selfish, pig-headed or unfit for that to be a realistic option, then gender of the parent should not be the determining factor, for custody. Fitness as a parent should.
