			<content:encoded><![CDATA[<div class="announcement_post"><p class="MsoNormal" style="margin: 0in 0in 0pt;"><span style="font-size: small; font-family: Times New Roman;">I am a father of three boys.<span style="mso-spacerun: yes;">  </span>I have one of them living with me as his mother had some &ldquo;issues&rdquo;.<span style="mso-spacerun: yes;">  </span>I am the one with <strong>parent custody</strong> (placement is the actual correct term here). The other two are living with their mom and I haven&rsquo;t seen them in about a year and a half due to her new husband and father in law both being lawyers and some mistakes in dealing with her on my part.<span style="mso-spacerun: yes;">  </span>So obviously in this case she is the one who has <em>parent custody</em>.</span></p>
<p class="MsoNormal" style="margin: 0in 0in 0pt;"><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0in 0in 0pt;"><span style="font-size: small;"><span style="font-family: Times New Roman;">One of the problems that I have seen in this system, which has worked both for and against me, is that unless you can afford a lawyer, your rights usually are not enforced.<span style="mso-spacerun: yes;">  </span>This is something that can be good and bad, but will rarely take into account what is best for the child or children.<span style="mso-spacerun: yes;">  </span>If both parties are reasonable, they can usually work things out, even if neither is entirely comfortable with the end result.<span style="mso-spacerun: yes;">  </span>This is usually when both parents are looking out for the child as opposed to their own self-interests.<span style="mso-spacerun: yes;">  </span></span></span></p>
<p class="MsoNormal" style="margin: 0in 0in 0pt;"><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0in 0in 0pt;"><span style="font-size: small;"><span style="font-family: Times New Roman;">The flip side of this is that one or both parties are not reasonable.<span style="mso-spacerun: yes;">  </span>This is far more common, and will usually end with either the person who is able to best afford the lawyer getting their way, assuming it&rsquo;s not totally outrageous, or an ongoing legal battle in which the children become pawns.<span style="mso-spacerun: yes;">  </span>Neither of these options are good for the kids more often than not.<span style="mso-spacerun: yes;">  </span></span></span></p>
<p class="MsoNormal" style="margin: 0in 0in 0pt;"><span style="font-size: small; font-family: Times New Roman;"> </span></p>
<p class="MsoNormal" style="margin: 0in 0in 0pt;"><span style="font-size: small; font-family: Times New Roman;">People need to learn to drop their agendas, their personal hurts, their own selfish wants and whatever bad feelings are left over for the sake of their kids.<span style="mso-spacerun: yes;">  </span>This in and of itself would solve a lot of issues when it comes to the <span style="text-decoration: underline;">parent custody</span> issue.<span style="mso-spacerun: yes;">  </span>Think about it, and then think of your kids.<span style="mso-spacerun: yes;">  </span>It can make all the difference in the world.</span></p>

We have had the child in our care since she left the hospital as a baby and we just wanna get legal custody of her now were on all of her doctor and daycare paper work and we have supported her from day one were the only parents she knows<br />
<br />First and foremost, you need to get an attorney licensed in family law.  Each states laws are a bit different.</p>
<p>If you have not already been doing so, you should start documenting your involvement with the child in a diary/journal, recording expenses, etc&#8230;  Since you did not mention the birth mother as being active in the child&#8217;s life, I am assuming her presence is either minimal or non-existant.  Start documenting any and all involvement (financial, physical or otherwise) in the child&#8217;s life as well.  The more documentation you can provide the better off you will be.  The fact that the doctor and daycare workers know you is a good sign, but do they also know the birth mother really well from doctor and daycare visits?  All of these things may come up.</p>
<p>You might want to do some research on DadsDivorce.com, it&#8217;s a free research website for men facing various family law issues such as adoption and custody.  Learn what you can about the process there but be sure to speak to a licensed attorney to learn what legal steps you need to take and what preparations you need to be making.</p>

<p>My Sister is going through a nasty custody battle. She is very young and didn&#8217;t hire a lawyer when she was served divorce papers. She wasn&#8217;t notified of any court date and all custody and property was given to her common law husband in Texas. She filed for a retrial and it was denied. In Texas the court system is so strange. No one will help you, unless you hire a lawyer and she doesn&#8217;t have the money for that. </p>
<p>My husband went through similar issues with my step sons mother, except she lost custody due to her having serious bipolar disorder and not being on medication. Long story short the judge told us that if we ever allowed my step son to visit Las Vegas (Where his mother lives) then the court order from California would have to be filed in Nevada for us to be able to enforce it. </p>
<p>I guess what I am getting at is, would it be the same for a court order in Texas being enforced in California? My lawyer said that IF he files a motion to have it filed in California then there was a possibility we could ask for the order to be modified. Anyone have any free legal advice for us?<br />
<br />Yeah, NEVER, EVER, ignore court papers.  Your sister basically lost custody because she didn&#8217;t try to get custody.</p>
<p>Your sister&#8217;s f**k up has made this a very complicated legal matter.  She should get an experienced attorney.</p>

<br />First, I have a hard time believing that if this was a legitimate kidnapping law enforcement would do nothing.  Further, if LE knew she was in danger, they would be issuing amber alerts and everyone would be looking for her.</p>
<p>Now, I&#8217;m not saying you don&#8217;t have a problem that needs solved, but lets not be so dramatic about it.  The fact is that if you really felt she was in such danger, why would you turn to the internet to save her?</p>
<p>Having said that, a local lawyer will most likely be your best option.  hiring the best in Texas may require a lot more financial backing than a local lawyer.  Because you are asking this question here, I presume your funding is likely limited.  So, to find the best lawyer in your area, open a phone book, call a few, ask what their win to loss ratio is, and see which one you like the best.</p>

Can someone tell me what are his chances of getting what is asked granted.  I know it depends on what they both(my husband and the ex decide) but has anyone else know of a similar case or know what will happen in a case like this?<br />
<br />he will probably get what he wants unless there is some reason that he shouldnt, he deserves what ever time he asks for&#8230;the mediation is to see if they can come to an agreement, but the final decision is up to the judge.</p>

<br />I am not a lawyer, all I can do is tell you the nightmare a friend of mine went through because of this very thing! It took her two years and she lost tax rights to her son because her x got a lawyer and they maneuvered the paperwork. She got out of it ok and got tax rights back after she got Legal Shield and was able to afford-ably go over the paper work and get the help she needed from a lawyer. There is a one time courtesy call if you want to call and ask. But then I suggest you purchase the service.<br />
Sorry to sounds like a salesperson, but fathers tend to get the raw end of the deal and I hate that! </p>

no, the kid should be taken away.</p>

<br />Yes. If mom is purposefully getting knocked up then leaving dads for the child support which can be obnoxiously high. That is abuse. Its psychological but its still abuse.</p>

<br />Social svcs doesnt do anything like that.  DNA tests are done through very expensive, private companies, that you hire with your own money.  And even then, no one has to submit to it, unless they are ordered to do so by the courts.  To even get to the courts, you must hire an attorney.  A private attorney that you hire, will also be very expensive.</p>
<p>Why he wants to find out if it&#8217;s his child, Idk.  Because that is going to be an expense on HIM if the child is his.  And if he is your bf now, that means this child is going to affect YOUR finances too, if you live with him.  If the child is well taken care of by her parents, I&#8217;d leave it be and wait til the child is 18 to go ahead and have reunions to get the &quot;i&#8217;m your father&quot; conversations out of the way&#8230; Good luck.   Also, &quot;threw&quot; is like a ball you throw.  &quot;through&quot; means like going THROUGH a process, like the courts, etc.</p>
