father lives in indiana , never married him, never had contact until child was nine when i took him to court, i have sole custody he has visitation. I moved out of state , only lived there 4 months prior to hearing, then came back to florida where i lived for 5 years because i lost my job there because of transportation issues.
You can't be charged with kidnapping as long as you continue to uphold your end of the visitation.

If you have custody then no you cant be charged with kidnapping, the kid is yours.

If you have custody then you can move to Japan if you want and no one can say anything unless there's a clause in the custody agreement preventing you from moving.

You can only be charged if it is in your custody agreement that the child not to be taken out of state without the other parents permission.
My friend for example, can't leave the county of Sacramento (visa versa) without the others written permission. If there is no such agreement, then you can not be charged.

It just depends on the dirty details of the visitation plan. In my friend's court issued visitation it says that both parents can not move out of the county. I would consult with your lawyer and be sure to tell the father he does have a right to know. Also once court issued custody is in place it doesn't matter if he was not in the child's life before even if it is mandatory be thankful that your children do have a father now.
