Me and my ex have joint custody with our 3 year old. She just recently got a raise at her job and now makes $50,000 a year compared to my $38,000 a year. I currently pay 400 dollars a month to her for child support even though we have joint custody. Does this sound bogus? I know I should ask a lawyer but I was wondering if this case has happened to you people out there and can share with me some similiar stories and how you guys resolved them. Thanks ya’ll
The problem I am having is, NOW she makes a lot more money than me. We have Joint custody which means we have her 50/50. I am responsible for her health care bills, I have to help pay for my daughter as far as food, clothes, etc. because she lives with me half the time. Why is it that I have to pay my ex for child support? Now I’m living in poverty, and she’s living wealthy. She doesn’t pay ME child support!!! The whole judiciary system is corrupt in my opinion
What is your state? In GA it would matter because CS is based on BOTH parents.
Also, joint in GA can mean every other weekend.
And in GA you can only get CS adjusted once every 3 years unless a major change occurs, which in your case it appears it has.
It costs less than $100 to go get a modification, but I think it will be worth it in your case.

Thankfully child support can always be recalculated. The reason you pay her $400/month is because that figure was produced based on her old income. Contact your lawyer and ask for a hearing to get child support recalculated. All the judge will do is punch your numbers and hers into a calculation table they use to figure child support quantities and see what the answer is. Your lawyer can do this for you as well, to see what kind of a difference it will make before you actually make the decision to go to a hearing.

Joint custody could mean any number of scenario’s. My ex paid me support and he had the kids every other weekend but they lived with me. At some point they need a constant home base for school and friends.
I have no idea what you’re arrangement is. But 400 dollars sounds like a decent amount. The money is to keep them. Towards the cost of their home, their entertainment, clothing, food etc
Everything it takes to keep that child.

Child support is not based on her income only on yours. Think of it like this, they want you to contribute the same amount so you pay her 400$ and she uses that money for little you. You wont pay less unless your pay drops or you are unemployed…no idea what state your in but in MA 400$ a month is the bear minimum that can be payed.

Et a copy of the guidelines and do the figures. If there’s at least a 20% difference in how much should be getting paid, than file a motion to modify.
