I had a son yrs back and the mother gave custody to a sister can she (sis) sue for support?
I did not know the child was alive for some time. The mother appears to have given up custody to her sister. I cannot get any information from CSEA and the sister will not correspond with me. I want my child and would like to have him with me since he is not with his mother. what can I do?

You need to contact an attorney, however, if your name is not on the birth certificate and the mom has never legally claimed you as the child’s father, you may not be able to do anything. The first thing that needs to be done is a DNA test, because you really don’t know for sure you are the dad. An attorney may be able to help you with getting this done, but if they deny that you are the dad, I think you are just up the creek. However, if the sister tries to sue for child support, you can at that time request a DNA test and if it comes back positive, then take her to court for custody.
