If the father is fit, can a mother gain custody after she gave up custody for a year?

I am a single father with two kids, we split a year ago, she has given sole physical custody to me in two separate MSA’s, am trying to finalize the divorce and she is now contesting it saying that we have reconciled(which has not happened) and wants to renegotiate custody. I reside and am filing for divorce in Virginia, what are the odds she can take the kids now after a year of this arrangement? She currently has reasonable and liberal visitation and pays child support.

The most common way used by women is a false allegation of child sexual abuse.

    The court is very funny sometimes. However, they do not like that she would have lied to them about reconciling.
    Do you have a lawyer?
    She will have to prove a lot of negatives about you in order to take the kids away at this time. She will have to prove why/what has changed with her to make the court uproot the children from you. Hope you have records of missed visits and anything else she missed.

    The only way she could get your children is if she says that she has been supporting them for the length of their being with you and you are unable to support them yourself. The allegation that she says that you have reconciled is contradicted by her asking for the custody of the children, so that is settled. Good luck with the divorce.

    It’s highly, highly unlikely that they will switch custody just because she wants it.
