Is there anyway that my wife and i can get custody of an unrelated child whose mother is doing drugs ?

The mother has admitted to doing drugs and when my wife went and picked up the baby she had bruises on her.Is there anyway that we can get emergency custody of this baby.

The first thing is to immediately take the child to the police station. They will photograph the bruises and call CPS. The CPS worker will come and investigate. If they determine the child needs to be removed (this depends on the location and type of bruises – a bruise on the shin of a child learning to walk in normal) they may evaluate you for placement. You would not have custody of the child but would be considered the foster parents.

If the child does not currently have any marks or injuries, call CPS directly (you can google the number for your area) and make a report. They will keep your name confidential – but be aware most parents know who sees their kids so they will likely know it’s you.

If CPS does not determine the child to be at risk, you have the option of filing for guardianship. You do this through probate court, not family court, and the parents will likely fight this. It will be your responsibility to prove they are unfit. Your best bet is getting CPS and law enforcement involved. Good luck to you!
