what are my rights to my new born baby if his mother wants to go for sole custody, also what are his rights?
I’m about to have a baby, the father however left me 4 mths ago and said he wanted nothing to do with the child, there have been no girls born into his family for the past 85 yrs.. i found out i was having a girl, now his mother wants custody of the child. is there anything i can do to stop this from happening right away, and can anyone tell me my rights aswell as his rights?
Relax a bit. Unless you are unfit there is no court in this world that will just give her your baby. Unless you use drugs, abuse alcohol, live in a sty, emotionally abuse the child, physically abuse the child, neglect the child, or sexually abuse the child… she is just blowing smoke up someone’s patooty.
Go to your family and ask them for financial assistance to hire an attorney. File for child support, primary custody (allowing him some visitation) and have your attorney respond to anything her attorney sends.
Do not argue with her. And she will try to bait you. Or argue with him. Speak only to him and only about the child. Let your voicemail or answering machine pick up her calls. Hang up if he argues with you and do not answer the door to him or her at this point. Listen to your attorney. And live your life and raise your child.
Do not allow her to visit the child until you have custody on paper. She has no rights to your child. Do not give her a chance to take off with your child.
As for the father’s rights, if he wants nothing to do with the child have your attorney send him the paperwork to sign off all rights. This means you get no money but also means you never have to deal with him again. And once he is out of your life, she will eventually follow. If he chooses not to give up parental rights, he does have the right to visit/and or shared custody with his child if the judge allows. Wait for the judge to rule. And, mind what you do. NO going out, partying, dating, sex, arguing, drugs, drinking, anything that can be viewed as irresponsible. Just work, parent and live your life and they have nothing to use against you.

Well first he will have to prove you are unfit in order to get full custody of the child. Unfortunately you will have to share custody it paternity tests prove he is the father and by the way tell his momma to mind her own business. She has no rights to your child. I think every child deserves to know who their father is IF the father is a good role model for the child. So give the guy a chance.

First she”ll have to prove that your an unfit mother. Unless she can do that, she’ll have no rights at all. So make sure you have accomadation, all the baby stuff, manage you money well, get has much organised as possible. If you are worried, go talk to a solicitor before hand to see where you stand.
Unless she has very good evidence, that your unfit to care for it, she’ll have an up hill battle.

In most cases the mother can get custody of a child in court unless they are proven to be unfit. If the father is paying child support they usualy are given visitation right. It can be set up where they can not take them out of state with out the permission of he mother. If the father is not paying child support they they may or may not depending on the court be granted visitation right. In most cases no. It would be best to check with a good lawyer to see what the law are in your state or country where you live as they all very. Good Luck.
