A father who has been denied access to his son is moving to strike a restraining order against him now that a clinical counsellor in the case has been accused of lying about his credentials.

Victoria lawyer Naomi McKay, who is acting for the father, said she’ll be trying to get into court as soon as possible to have the order quashed.

McKay said the case has been a “nightmare” for the father, who was accused of abuse and, at one point, was prevented from seeing his son for more than six months “First priority is setting aside that order and getting back to a regular routine with his son,” she said. “He was seeing his son three times a week. So that’s his number 1 priority.”

The boy was interviewed in August by counsellor Jason Matthew Walker, who later reported possible abuse involving the father to both Saanich police and the Ministry of Children and Family Development. Walker’s sworn affidavit about that interview was then used in the child-custody case to obtain a restraining order against the father.

The case was heard in the father’s absence and he has yet to have his day in court, McKay said.

Saanich police, who investigated the abuse complaint, now allege that Walker lied in the affidavit by claiming to be a doctor of forensic and behavioural sciences. He also attached a resumé to the affidavit that said he held two doctorate degrees.

Police say Walker, 31, doesn’t have a doctorate, and that he has been misrepresenting his credentials. He was charged Dec. 31 with fraud, making a false affidavit and uttering a forged document.

McKay said any file in which Walker’s evidence was considered persuasive should come under scrutiny. “There will be a lot of stones being turned over,” she said.

Currently Dr. Walker holds academic appointments at the University of Victoria and University of BC in the Department of Medicine and a cross appointment to the School of Child and Youth Care.

Currently, Dr Walker is in private practice in Victoria (Health Point Consulting Inc.) focusing on child, youth and family issues, child custody access/parenting capacity, general counseling & forensic consulting on child maltreatment. Dr. Walker was recently appointed as a member of Accreditation Canada for Health Care.

He has held roles including: Paramedic, Child Protection Investigator, Advisor for the Government of BC (Health Care and Child Welfare), Advisor for the Government of Canada (Department of Justice), Deputy Regional Coroner, Reserve/Auxiliary Constable (Saanich Police) among his many community service roles he is Secretary of the Board for the Boys and Girls Club Services of Victoria, Director of the Board for Greater Victoria Victim Services, and Vice-Chair for the St. John Ambulance.
His research and clinical interests include: child welfare, forensic assessment of child maltreatment, high risk behavior in youth (prevention), quality assurance and best practices, development of integrated systems of services for health care and social services and public health issues related to infection prevention and control of disease/disease surveillance.

Dr. Walker has received national media attention for his work with children and youth in health care and social services among his international, national and provincial accolades and awards, he has been honored with the Canadian Medal of Honor for Community Services by the Government of Canada; The Order of St John; and the Queens Medal for Humanitarian Service to Mankind; along with multiple academic scholarships and fellowships.

I need your help please, my daughter, Sarah El Gohary, lives in Mit Ghamr, Dakahlia Egypt. Sarah was stolen from me by her father, Magdy Ali El Gohary at the age of three years old, he took my baby from Honolulu, Hawaii, U.S.A. almost twelve years ago, since May 23, 1997, I have had no contact with my daughter at all, the El Gohary family refuses to let me see my daughter or talk to her. I won custody of Sarah in America in 1997, since then, I have lived in Egypt four times, hired an Egyptian lawyer, won custody in an Egyptian court, and still, I have had no contact with my daughter. The El Gohary family has money and they pay people to do what they want, they have hidden my daughter for twelve years. The family has threatened to harm me if I ever came to Egypt but I put aside my fear, for my daughter, and lived there anyway, I would do anything for her.
I have gone on television, I have been to Washington, D.C. many times to speak with the U.S. government, I have met with The Grand Mufti and he issued a fatwa for Mr. El Gohary, I met the Ambassador to Egypt, I have done everything possible to try and see my daughter but the El Gohary family kept hiding my daughter and running from the law. I have won custody twice in Egypt, once temporary custody and then full custody but Mr. El Gohary kidnapped my daughter again and went into hiding for a year, when he resurfaced, he had gone into court and won custody over mine.
My daughter Sarah will be fifteen years old in April 2009, then she will automatically be under the father’s custody, this is what the family is counting on.
Sarah wanted to see me in 2005 the first time I won custody, two social workers from the court reported that to my Egyptian lawyer. Mr. El Gohary said ‘no’, so I never got to reunite with my daughter. I have no idea what my daughter thinks or what she has been told. I only know one thing she was told, the family told her I was dead. Now she knows I am not dead, what is this doing to her mentally? I was a stay at home mother with Sarah for a little over three years, and then suddenly, she was ripped away from her mother, her home, and everything she knows, and was taken to Egypt and told her mother was dead.
Mr. El Gohary has married since taking Sarah to Egypt, she has many brothers and sisters, but she is the only one without her real mother. I look up at the sky a lot at the moon and think to myself that at least I know my baby and I can see the same moon, then I sing, “Amar Amar” and hope she can hear me, I hope she can hear me cry for her every day, I miss her so much it hurts. She is my only child, I gave birth to Sarah when I was 41 years old. Sarah is my miracle. I have missed most of her childhood, I never got to see her first tooth come out, I never got to take her to school, Mother’s Day is so very difficult for me, I feel like my heart is ripped out of me.
I have tried so hard to make contact with Sarah in every way I know how, I need the help of my sisters and women to try and contact my daughter or the family to plead with them to let me see my child. I will never be happy again in my life until I can hold my Sarah, I
love and miss her so much I cannot breathe sometimes. I am begging anyone, mothers, who can feel my pain to please help me make contact with Sarah. Maybe someone knows what school she is in, or someone might know if she has an email address. This is my email address, if it can be passed to Sarah, please let her know that her mother is trying to contact her.

My name is Janet Greer, Sarah El Gohary is my fourteen year old daughter. Her nickname is “Aya”. Her family lives in Mit Ghamr, about two hours north of Cairo. The El Gohary family owns many shops in the town as well as an ice cream factory and they manufacture other foods. The American Embassy in Garden City Cairo is very aware of this case, you can give them any information you may have in confidence.
Please help me reunite with my daughter Sarah, I am her mother and she has a right to see me but the family is keeping her from doing this, I am sure she fears them.
