Even though Federal Gov’s guidelines require states to modify child support and base the amounts on factual figures and actual income in order to receive federal grants, Florida family law judges and FDOR routinely ignore Federal law. Clerk’s of court even get in on the corruption by not filing non custodial parents petitions, charging illegal fees for filing, failing to notice non custodial parents of hearings, not mailing motions and orders, delaying transcriptions etc. This is an audio of an actual contempt hearing held on Dec. 6, 2010 where clerk, hearing officer and child support enforcement attorneys collude and attempt to cover up their unlawful actions and denial of due process. Florida simply WILL NOT do downward mods and getting the clerk in Orange Co. to even file your petition for mod is nearly impossible as you’ll see in this video. If you are a non custodial parent, you are truly a second class citizen in Florida. Don’t move here unless you enjoy debtor’s prison and having the state tell you where and how you can work. Florida is one of only five states that doesn’t provide attorneys to indigent and low income non custodial parents in contempt hearings. Currently the right to counsel issue is in the US Supreme Court in the case of Turner v. Price. Let’s hope we finally get some justice in Florida’s corrupt family law courts.

“People come in frequently, and they think that because they’re the woman that they’re automatically going to get custody or because they’re the man they’re not going to get custody. And I don’t think that that’s necessarily true. I think that courts are very smart; they consider all of the evidence that is presented to them, and I don’t think that because you’re female you necessarily have an advantage.

Having said that, I will say that I think that the person who has been the primary caretaker of the child does have an advantage, provided that that person has been a good caretaker, and I think traditionally in our country that women have been primary caretakers. I think that’s changing. I see a number of men who come into my office who are stay-at-home dads while their wives go out and work. So in general, no, I don’t think that it matters whether or not you’re a male or a female with respect to custody issues.”
