Many people who file in juvenile court don’t realize that they can have the court issue a subpoena duces tecum, which is a subpoena directly to your husband’s employer asking for his pay records for the last year or two. So, when you go to court to petition for spousal or child support, in any juvenile court in Virginia, ask the court for the appropriate form so that you can send the subpoena duces tecum to his employer, who will be ordered under that subpoena to provide records directly to the court, so this way you’ll be able to learn exactly what his income is at the time that you file the subpoena duces tecum. It’s a simple way to get the information you need and you need to take with you, obviously, the name of his employer and probably, if you know who the human resources person is at his employer, that’s helpful. Otherwise, you just have to send the subpoena to the company, or the president of the company or to the keeper of records of the company.
